Five or more employees. Alabama requires workers compensation once a business reaches five or more employees under Code of Alabama Sec. 25-5-50, higher than Georgia’s three-employee threshold. A Business Owners Policy does not include workers compensation — it is always a separate policy, and Alabama employers who cross the five-employee threshold need it in place regardless of whether they carry a BOP.
