What Is Occupational Accident Coverage for Gig Workers?

Occupational accident coverage is a type of policy that pays benefits to an independent contractor who is injured while performing work for a platform. It is not workers’ compensation. It is a contractual insurance benefit offered voluntarily by some gig platforms that functions similarly to workers’ compensation in certain respects, covering medical expenses, disability income, and death benefits, but without creating an employer-employee relationship or carrying the legal protections of the workers’ comp system.

How does occupational accident coverage differ from workers’ compensation?

Workers’ compensation is a state-mandated system covering employees injured on the job. It provides medical benefits, wage replacement, and rehabilitation, and it is an employer’s legal obligation for covered workers. Independent contractors are excluded from workers’ comp in Georgia and most other states. Occupational accident coverage is a voluntary product. The gig platform chooses to offer it, sets its own terms and limits, and may exclude or limit benefits for certain types of injuries or circumstances. Uber offers an opt-in occupational accident program called Optional Injury Protection, underwritten by Atlantic Specialty Insurance Company. Georgia drivers who enroll pay $0.024 per mile driven for Uber. The program provides up to $1,000,000 in medical expense coverage (no deductible or copay), up to $500 per week in disability income, up to $150,000 in survivor benefits for the driver’s family, $50,000 in accidental death coverage, and $200,000 in accidental dismemberment coverage. It is available in Georgia and 41 other states. For example, a driver hospitalized for three weeks after a crash while on an active trip would receive up to $1,000,000 in covered medical expenses at no cost, plus up to $1,500 in disability income during recovery.

What does Lyft’s occupational accident program offer Georgia drivers?

Lyft provides an occupational accident program to drivers in California, Massachusetts, and Minnesota at no cost. Georgia Lyft drivers do not have access to a Lyft-provided occupational accident benefit. Lyft drivers in Georgia who want first-party injury protection must obtain it through their own health insurance, MedPay on their personal auto policy, or through Uber if they also drive for Uber. What do delivery platform programs provide for gig workers?

DoorDash offers a Dasher Safety program in some markets that includes occupational accident-style benefits. Amazon Flex provides occupational accident coverage during active delivery blocks. Instacart’s Shopper Injury Protection is an occupational accident policy covering the shopper’s own medical expenses during active shopping blocks. None of these are workers’ compensation, and none provide liability coverage for third-party claims.
