How does this work in Alabama?
Alabama's surplus lines market is the primary placement channel for risks that fall outside standard admitted carrier appetite: vacant or under-construction commercial buildings, properties with prior claim history, contractors with difficult loss runs, and operations that admitted carriers decline outright. That framework requires the risk be genuinely unobtainable from an authorized insurer after diligent effort, and placement through a licensed surplus lines broker. Alabama law does not require builders risk on construction projects, but lenders and construction contracts routinely do, and US Assure is an available market for those placements. For operations that serve alcohol, Alabama goes further than most states: its dram shop act (Code of Alabama Sec. 6-5-71) creates liability exposure for licensees who knowingly serve a visibly intoxicated patron, and the Alabama ABC Board separately requires every retail alcohol licensee to carry at least $100,000 per occurrence in liquor liability insurance as a condition of the license (ABC Board Rule 20-X-5-.14), an actual insurance-purchase mandate, not just liability exposure. Inland marine coverage for contractor tools and equipment in transit, commercial flood insurance (a standard commercial property policy excludes flood universally), and pollution liability for properties with environmental exposure are other common placements in this category. Non-admitted (surplus lines) policies are not backed by the Alabama Insurance Guaranty Association (AIGA), which pays covered claims only for admitted carriers that become insolvent -- a disclosure Alabama law requires at bind.

Common Mistakes
Assuming specialty coverage claims work the same as standard market claims. Non-standard carriers have more latitude in how they handle claims, and state guarantee fund protection may not apply. Not reading the specific notice and reporting requirements in the policy before calling.
